A Local Law to amend the New York city charter and the administrative code of the city of New York, in relation to distributing information on public health insurance options at day care centers.

 

Be it enacted by the Council as follows:

 

Section 1. The New York city charter is amended by adding a new section 1069.1 to read as follows:

§1069.1 Distribution of pamphlet on public health insurance program options in day care centers. Each day care center shall be required to distribute the pamphlet on public health insurance program options provided to it by the department of health and mental hygiene pursuant to subdivision b of section 17-183 of the administrative code of the city of New York to those individuals who appear in person to register a child in such day care center. Day care centers shall also be required to ensure that pamphlets on public health insurance program options are made available to parents and/or guardians on the premises of such centers throughout the year. For the purposes of this section, “day care center” shall mean any child day care facility operating in New York city that is required to obtain a license from, or to register with, the department of health and mental hygiene pursuant to section 47.05 of the New York city health code and/or the New York state department of social services pursuant to section 390 of the New York state social services law.

§2. Section 17-183 of the administrative code of the city of New York is amended by lettering the existing text as subdivision a and adding a new subdivision b to read as follows:

b.  The department shall ensure that pamphlets on public health insurance program options are provided to all day care centers in sufficient quantity to enable such day care centers to satisfy the requirements of section 1069.1 of the New York city charter.  For the purposes of this subdivision, “day care center” shall mean any child day care facility operating in New York city that is required to obtain a license from, or to register with, the department pursuant to section 47.05 of the New York city health code and/or the New York state department of social services pursuant to section 390 of the New York state social services law.

§3. Effect of invalidity; severability.  If any section, subsection, sentence, clause, phrase or other portion of this local law is, for any reason, declared unconstitutional or invalid, in whole or in part, by any court of competent jurisdiction, such portion shall be deemed severable, and such unconstitutionality or invalidity shall not affect the validity of the remaining portions of this local law, which remaining portions shall continue in full force and effect.

§4.  This local law shall take effect on July 1, 2008.
