This bill would make the possession of unsafe e-bikes and e-bike batteries unlawful. A person who possesses such unsafe e-bikes and e-bike batteries would be liable for a civil penalty of zero dollars for a first violation and for subsequent violations would be liable for a civil penalty of up to $1,000. A person who sells such unsafe e-bikes and e-bike batteries would be guilty of a misdemeanor punishable by up to 1 year imprisonment in addition to the existing civil penalty of up to $1,000. Finally, a person who assembles or sells second-use lithium ion batteries would be liable for a civil penalty of up to $1,000 and would be guilty of a misdemeanor punishable by up to 1 year imprisonment.
