This bill would require the Commissioner of Information Technology and Telecommunications to allow for notice and comment before installation of LinkNYC public communications structures (PCS). After receiving an installation application, the Commissioner would have to notify all residents within 500 feet from a proposed PCS, and the Community Board, Council Member, and Borough President with jurisdiction over the proposed site, within 15 days. The Commissioner would have to allow public comment for 30 days for applications to solely modify existing PCS, and 45 days for other applications. The Commissioner would have to solicit feedback from the Council Member and Borough President for an additional 15 or 30 days after the end of the relevant public comment period. The Commissioner would be required to review comments and feedback before ruling on an application, as permitted by federal law or regulation, and to publish a final determination notice online.
