This bill would ban the practice of giving live fish as a prize for any game, drawing, contest, sweepstakes, or other similar promotion. This ban would not prohibit food service establishments or retailers from providing live fish for human consumption at a reduced rate. The holder of a street activity permit sponsoring a street event would be required to prevent any person at that event from giving live fish as prizes in violation of this law. The Director of the Street Activity Permit Office would be required to notify event sponsors of their obligations under this law, and applicants would be required to certify that they understand these obligations when applying for a street activity permit. The Director of the Office of Animal Welfare would be required to create materials to inform the public of this ban, the harms posed by disposing live fish in the city’s waterways, and best practices for caring for pet fish.
